The purpose of this study is to highlight the inappropriate transposition process of this Directive, especially most critical aspects covered by this law. Consecutively, the margin for improvement required by some of its precepts is undertaken, which not only compromises the effectiveness of the legal act of the European Union, but also raises doubts concerning ownership of national and sectoral legislation. Finally, some gaps with regard to the objective and subjective scope of this Spanish law are identified, with a faithful reflection of those national legislations that are more consolidated with the aim to propose some answers as a *lege ferenda* on the future reform of the law.El 20 de febrero de 2023, se aprobó la Ley 2/2023 reguladora de la protección de las personas que informen sobre infracciones normativas y de lucha contra la corrupción, por la que transpone la Directiva 2019/1937 relativa a la protección de las personas que denuncian infracciones del Derecho de la Unión. El objeto del presente estudio radica en poner de relieve el deficitario proceso de transposición de esta Directiva, especialmente, de aquellos aspectos más críticos que contempla esta ley. Consecutivamente, se acomete el margen de mejora que requieren algunos preceptos legales que no solo comprometen la efectividad de este acto legislativo de la Unión Europea, sino que generan dudas de encaje constitucional con otras normas nacionales de carácter general y sectorial.
