In the digital environment, the new information and communication technologies have led to the creation of new figures and realities, among which virtual memory stands out. However, faced with a permanent, indelible, decontextualized and indefinite reality, such as that stored by artificial intelligence, arises the need for a regulation that guarantees the respect of human dignity. For this reason, the digital transformation has moved the authorities to promote the consolidation of legislative, administrative and judicial solutions that recognize and guarantee digital rights. Since the Google Spain and Google case of the European Union Court of Justice in 2014, there have been several litigious issues that have revolved around the recognition and scope of the judicially created, right to be forgotten. Although its beginnings date back to the European legal framework, currently, cases such as the ones present in Argentina, Perú and Colombia, reveal that the need and invocation of a right to be forgotten has reached the American continent. Taking into account this legal trend, questions arise such as: what is the iusphilosophical approach of this right? Is it a new right or the extension of an existing one? Is it intended to protect a new legal asset or, on the contrary, a new risk to legal assets already protected?

Sin embargo, frente a una realidad permanente, indeleble, descontextualizada e indefinida, como la que almacena la inteligencia artificial, surge la necesidad de una regulación que garantice el respeto a la dignidad de toda persona. Por tal razón, la transformación digital ha movido a las autoridades a impulsar la consolidación de soluciones legislativas, administrativas y judiciales que reconozcan y garanticen los derechos digitales. Desde el caso Google Spain y Google del Tribunal de Justicia de la Unión Europea en el 2014, varios han sido los asuntos litigiosos que han girado alrededor del reconocimiento y los alcances del judicialmente creado, derecho al olvido. Si bien sus comienzos se remontan al marco jurídico europeo, en la actualidad, casos como el de Argentina, Perú y Colombia, revelan que la necesidad e invocación de un derecho al olvido han llegado al continente americano.
