Summary: Article 42 of the EPPO Regulation establishes what it calls "judicial review of acts of the European Public Prosecutor's Office". This rule contains a complete regulation in two respects that should be identified and studied separately: on the one hand, it makes all acts of the European Public Prosecutor's Office intended to have legal effects on third parties subject to judicial review, distinguishing between procedural acts and non-procedural acts (A). It also divides jurisdiction for the exercise of this judicial review between the national courts and the institution of the European Union endowed with judicial power, the Court of Justice of the European Union (B).
