O problema de pesquisa busca responder, assim, se o atual Estado de Direito se caracteriza como um Estado de Direito Socioambiental, estudando-se, para tanto, a Teoria do Estado formulada por Hermann Heller, em que se destaca o Estado de Direito Social. Com relação à metodologia empregada, adotou-se o método indutivo de pesquisa, o qual parte da análise de casos específicos para se chegar à conclusão do tema. O artigo foi produzido por meio de levantamento bibliográfico e operacionalizado pelas técnicas do referente, das categorias básicas, dos conceitos operacionais e do fichamento.Palavras-chave: Estado de Direito Social; Estado de Direito Socioambiental; Teoria do Estado.Abstract: This article aims to analyze the evolution of the Social State to the new Socio-Environmental State of Law model seeking to manage the risk society. Its overall goal is to answer if the current Social State is characterized as a State Environmental Law, studying, therefore, the Theory of the State, formulated by Hermann Heller, which highlights the state Social Law. The methodology was used in inductive research phase.
