Laburpena: The article deals with the business implementation of geolocation devices of the worker both in the light of judicial decisions and the content of Ley Orgánica 3/2018, of December 5, de Protección de Datos y Garantía de los Derechos Digitales. Starting from the unquestionable consideration of location data as personal data, the analysis focuses on the requirements related to the legality of obtaining and processing such data as well as the necessary balancing between business interests and the fundamental rights of the worker, either to privacy (art. 18.1 CE) or to particular computer freedom (art. 18.4 CE). Consequently, the different hypotheses of confrontation between the control function of the mentioned devices and the worker’s privacy are considered, establishing in what cases and under what conditions such control is legally possible; with a particular attention to the information rights strongly revalued by the data protection regulations.
