Summary: The Grand Chamber of the Court of Justice of the European Union has ruled on the question referred for a preliminary ruling in December 2019 by the Court of First Instance of Riga for a preliminary ruling on the interpretation of Articles 11(a), 17 and 22(1) of Protocol No 7 on the privileges and immunities of the European Union. It analyses the possibility of national central bank governors being able to benefit from immunity from jurisdiction when they perform official acts as members of a Union body, while undertaking an in-depth review of key questions such as the purpose and scope of this protection, the role of the European Central Bank in determining whether or not to waive immunity when Union interests may be affected, and even whether immunity also covers criminal proceedings or evidence obtained by the competent national bodies.
