This paper addresses the need to protect the creations of intelligence, which manifests
itself, on the one hand, in the protection of industrial property and, on the other, in
the defense of copyright. As a question prior to a rigorous response on the modes of protection,
it is necessary to analyze the legal nature of these two classes of special properties.
With industrial property, it is about protecting the creations of the human intellect aimed
at promoting technical progress, which result in the social welfare of a country. Copyright
is intended to protect aesthetic, scientific or musical creations that serve the ideal needs
of humanity. Lastly, plagiarism is analyzed as the main copyright infringement. |
