This article aims to describe and analyze the legal and environmental protection related to
mining activities on the Brazilian continental shelf. For that, this research uses the descriptive
method and the qualitative approach. The primary sources of this research are composed of
international law and Brazilian norms, government documents, and Brazilian jurisdictional
decisions. Notwithstanding legislation and jurisprudence ensuring the protection of the
environment, mining on the continental shelf still lacks the consolidation of effective criteria
for environmental protection, particularly concerning the application of the precautionary
principle, given the scientific uncertainty regarding environmental impacts. |
