According to the teleological nature of this fundamental component of the new model of criminal prosecution, the functions of accusation and trial are autonomous and independent, to the extent that, in its strict conception, the judge cannot investigate and the prosecutor cannot judge.  The central purpose of this article is to analyze possible areas of relativization in the exercise of criminal action by the Attorney General's Office.Desde a implementação do acto legislativo 003 de 2002 e a subsequente promulgação da lei 906 de 2004, a Colômbia deu lugar ao chamado sistema penal oral acusatório.  Um dos pilares essenciais do processo criminal moderno incorporado no nosso sistema foi o princípio acusatório. De acordo com a natureza teleológica desta componente fundamental do novo modelo de processo penal, as funções de acusação e julgamento são autónomas e independentes, na medida em que, na sua concepção rigorosa, o juiz não pode investigar e o procurador não pode julgar.  O objectivo central deste artigo é analisar possíveis áreas de relativização no exercício da acção criminal pela Procuradoria-Geral da República.Desde la implementación del acto legislativo 003 del 2002 y la ulterior promulgación de la ley 906 del 2004, se abrió camino en Colombia al denominado sistema penal oral acusatorio.  Uno de los ejes esenciales del moderno proceso penal incorporado en nuestro ordenamiento fue el principio acusatorio.
