Summary: The article addresses prior consultation in the Inter-American Human Rights System and the effectiveness of the protection provided when communities make use of the instruments to seek the safeguarding of their rights through petitions before the Inter-American Court of Human Rights or the Inter-American Commission on Human Rights. The reflection on the prior consultation is advanced from the context that defines the importance of the preservation of the cultural identity of the ethnic groups with respect to the decisions that affect them and with respect to the defense of their rights. It is concluded that, from the theory, the defense of the prior consultation by the Inter-American Human Rights System is effective; However, in practice, it is evident that, on the part of the States, actions are carried out that compromise ignorance of the respect, protection and guarantee of Human Rights.
