%0 Article %A Montoya Tabares, María Sara %D 2010 %T La judicialización de los derechos sociales, económicos y culturales en Colombia %U https://dialnet.unirioja.es/servlet/oaiart?codigo=7830083 %X This paper explores some of the rationale that makes it possible to reflect on our political constitution’s lack of effective protective mechanisms such as, e.g. enforcement actions. On the other hand, it also proposes solutions aimed at ensuring that these rights do not remain mere expectations, suggesting the use of efficient mechanisms of protection that force the state to make budgetary provisions and create a fund that can be used for supporting implementation of these kinds of mechanisms. Taking into account the fact that the provisions in the current international agreements are legally enforceable, this paper has the additional purpose of urging international entities that see to the performance of these agreements to create enforcing bodies that take actions in the compromised states. This would be done for the purpose of guaranteeing that their decisions are not left as simple recommendations - as has occurred thus far -, but rather transcend and become actual socioeconomic policies in the agendas of the government administration that happens to be in power, so that they have positive repercussions on the satisfaction of the needs of the collective society
