For this reason, a specific rule on this topic has been approved, the RD-Law 28/2020, 22 September, of distance working. From these premises, the aim of this work is to deal with collective representation rights of distance workers in the RD-Law 28/2020. Although this issue has a more detailed regulation than in the previous legislation, it continues to pose diverse problems, some of which are not but the reflection of the obsolete character of the Title II of the ET in some aspects, being necessary its update to the new business realities and forms of provision of services arisen in the last decades. Thus, firstly, we will refer to the provisions that, on this matter, were contained in the legislation prior to the RD-Law 28/2020, and, secondly, we will focus on this last rule, highlighting the new aspects and the lacks that, from our point of view, it continues to have in this regard.causada por la COVID-19 puso de manifiesto las carencias e insuficiencias de la regulación del trabajo a distancia en nuestro ordenamiento jurídico, razón por la cual se ha aprobado una norma específica en esta materia, el RD-Ley 28/2020, de 22 de septiembre, de trabajo a distancia. Partiendo de estas premisas, el objetivo de este trabajo es abordar el estudio de los derechos de representación colectiva de los trabajadores a distancia en el RD-Ley 28/2020, una cuestión que, aun cuando cuenta con una regulación más detallada que en la normativa precedente, sigue planteando diversos problemas, algunos de las cuales no son sino el reflejo del carácter obsoleto del Título II del ET en algunos aspectos, siendo necesaria una actualización acorde a las nuevas realidades empresariales y formas de prestación de servicios surgidas en las últimas décadas.
