Beyond it, this judgment for the first time requires that the danger should be examined through contextual, intentional and pragmatic-linguistic elements. However, the commented judgement also presents shadows, since it maintains a distorted conception of hate speech and does not sufficiently specify the standards that justify a limit to freedom of expression.La STC 35/2020, de 25 de febrero ha supuesto la consolidación de una jurisprudencia que ha sentado que sólo será constitucional reaccionar penalmente frente a discursos extremos, y en particular ante expresiones enaltecedoras del terrorismo, cuando tengan carácter incitador y resulte un peligro de que como consecuencia de su difusión pública puedan tener lugar actos violentos o discriminatorios. Pero esta sentencia va más allá y por primera vez exige que esa peligrosidad se acredite a través de toda una serie de elementos contextuales, intencionales y pragmático-lingüísticos.
