Laburpena: In June 2014 the Assembly of Heads of State and Government of the African Union(au) meeting in Malabo (Equatorial Guinea) adopted the Protocol to Amend theStatute of the African Court of Justice and Human Rights, known as the Protocolof Malabo; that, among other issues, set up the International Criminal Law Section(icls) and its jurisdiction to prosecute crimes against humanity, genocide, and war. The initiative responds to the tensions that have arisen in recent years between some African states, the au, and the icc. In despite that no state has ratified the Protocol of Malabo to date, its mere adoption has opened the debate regarding the exercise of international criminal justice in Africa; primarily, due to jurisdictions conflicts that could arise between both courts. The purpose of this paper is to examine the victim’s participation before the icls regarding the Internal Crime Court (icc) system and to suggest any ways to make up loopholes. Finally, researchers would like to conclude if the victim’s participation system is a procedure the icls must follow.
