Sumario: This paper will argue that local autonomy is inadequately equipped in areas or sectors for which the state or region is responsible according to the foundation-development dichotomy. I will focus on the analysis of constitutional jurisprudence in order to show the inherent contradiction of sentences which firstly relate, and then distinguish, organising into a hierarchical structure, Articles 137, 140 and 141 of the Constitution with Article 149.1.18 - in other words the Articles which deal with constitutional guarantee of local autonomy and the Article which cover the distribution of functions and responsibilities in local government. The final part is dedicated to setting out the parallels, despite the obvious differences, between regional autonomy and local government, taking concepts of foundation and the supralocal nature of areas of responsibility as points of reference.
