Summary: The present article analyzes the form as the law of movable guarantees has helped to promote the access to the credit, and to invigorate its granting on the part of the financial institutions. From the study of some of the new juridical figures dedicated in the law, the possible affectation will be examined to the institutes of the real rights, and the affectation in the juridical safety of the creditors. In the same way, will check the way how the law dedicated the figures of the appropriation and apprehension of the good like part of the mechanisms so that the creditor is done to the property of the good happened in guarantee, it appears now allowed by the express abolition of the agreement pignoraticio.pignoraticio.
