This investigation paper attempts to perform a positivist approach to the unity and coherence of international law, based on a documental scrutiny of the conceptions of Hans Kelsen and Herbert Hart on these two properties of law applied to the international normative system. Likewise, this paper characterizes the development of international law as fragmented, that is, created from regimes closed by the cognitive content regulated in them, a situation which makes it susceptible to the presence of conflicts between norms, which, precisely, could be avoided in a sufficiently unitary and coherent law.

De même, le développement du droit international se caractérise par une fragmentation, c’est-àdire créée à partir de régimes fermés par le contenu cognitif qui y est réglementé, ce qui le rend vulnérable à la présence de conflits de normes qui, précisément, parvient à s’échapper dans un droit suffisamment unitaire et cohérent.Este artigo de pesquisa propõe uma abordagem positivista da unidade e coerência do direito internacional, a partir de uma pesquisa documental das conceições de Hans Kelsen e Herbert Hart sobre estas duas propriedades do direito aplicadas ao sistema normativo internacional. Igualmente, caracteriza-se o desenvolvimento do direito internacional como fragmentado, isto é, como produto de regimes fechados por causa do conteúdo cognitivo que neles se regula. Esta situação ocasiona a presença de conflitos entre normas no direito internacional, o que se evita justamente com um direito adequadamente unitário e coerente.Este artículo de investigación se dedica a realizar una aproximación positivista de la unidad y la coherencia del derecho internacional a partir de un rastreo documental de las concepciones de Hans Kelsen y Herbert Hart sobre estas dos propiedades del derecho aplicadas al sistema normativo internacional.
