The purpose of this work is to reflect on this legal, doctrinal and jurisprudential conflict existing in the Colombian legal system, regarding the possibility to acquire by prescription the transmission and distribution of electrical energy easements. It is necessary to establish that this study mainly revolves around two figures of civil law specifically: prescription and easements, and on the electrical energy utility. These notions have been studied separately but, once combined and applied to the regime of transmission and electrical energy distribution easement, they evidence an interesting aspect of controversy and different doctrinal and jurisprudential postures.Este artículo tiene como objetivo analizar la figura de las servidumbres eléctricas y su posibilidad de ser adquiridas por prescripción a partir de lo establecido en el artículo 939 del Código Civil colombiano, norma que dispone que las servidumbres continuas y aparentes puedan adquirirse bajo esta figura. Este trabajo tiene como finalidad reflexionar sobre este conflicto jurídico, doctrinal y jurisprudencial existente en el ordenamiento jurídico colombiano, respecto a la posibilidad de adquirir, por prescripción, servidumbres de transmisión y de distribución de energía eléctrica. Es preciso establecer que este estudio gira sobre dos figuras del derecho civil como son: la prescripción y servidumbres; y sobre el servicio público domiciliario de energía eléctrica.
