The categorical imperative is the universal moral law, on which the doctrine of law and the doctrine of virtue are based. The doctrine of law contains private and public law. The latter constitutes the core of the Theory of state, which is a pure doctrine, deduced from a priori principles, such as the idea of a transcendental liberty and the categorical imperativ. This paper analyses how this aprioristic deduction of the state reality is possible, how the state means the realisation of the law and which ones are the principles on which the idea of the state is built. The paper proposes the state as public law, the form of the state as a republic and its external projection as the law of peoples and cosmopolitan law towards the goal of a perpetual peace.El objetivo de este estudio es exponer la teoría del Estado de Kant como el resultado de un proceso de deducción a partir de principios a priori de la razón. Como facultad de los principios, la razón, en su uso práctico, formula el imperativo categórico, del cual se obtiene, por deducción trascendental, la idea de libertad. A su vez, el imperativo categórico es la ley moral universal, en la cual se basan la doctrina del derecho y la doctrina de la virtud. La doctrina del derecho contiene el derecho privado y el derecho público. Este último constituye el núcleo de la teoría del Estado, que es una doctrina pura, deducida a partir de principios a priori, como la idea trascendental de libertad y el imperativo categórico. Aquí se analiza cómo es posible esta deducción apriorística de la realidad estatal, cómo el Estado significa la realización del derecho y cuáles son los principios sobre los que se construye la idea de Estado.
