The objective of the article is to reflect on the influence of neo-liberalism on the generation of crime in our unequal society, with reference to the region, in order to focus differently on the understanding of crime and worry about recovering humanism against the current policy that exacerbates individualism, consumerism and the accumulation of often superfluous goods.En este artículo se analiza el problema del incremento sostenido de la criminalidad intra clase e inter clase en el ámbito nacional, así como la respuesta penal del Estado que resulta en la construcción desbordada de nuevos tipos penales, la elevación arbitraria y draconiana de la duración de las penas y la eliminación de beneficios penitenciarios, expresiva de una preocupante situación de gobernanza a través del crimen que no quiere ni permite superar el álgido problema de la cuestión criminal.
