A worker, who provided the services to a diplomatic mission, does not have the opportunity to go to the labor jurisdiction to claim labor credits because of the legal immunity, that was established since 1961 Viena’s Convention about Diplomatic Relations. This theory is now controverted, it can be seen at the Supreme Justice Court and the Constitutional Court sentences. The relative legal immunity is the last theory that is accepted by the international law based on New York convention about states legal immunity and their property, which compiles the international costume about this topic. Once in Colombia was accepted the second theory but it was change to the first one and to protect labor rights was open the door to Colombian responsibility recognition and any responsibility of the other state.

Esta teoria hoje é rebatida, e fiel reflexo disso é a jurisprudência das altas corporações colombianas como a Corte Suprema de Justiça e a Corte Constitucional. A última teoria que se maneja pelo direito internacional é a da imunidade jurisdicional relativa, a qual teria sustento na Convenção sobre as Imunidades Jurisdicionais dos Estados e de seus Bens, adotada dia 2 de dezembro de 2004 em Nova York, que reúne o costume internacional sobre o tema. A Colômbia em um momento aceitou a segunda teoria mas voltou à primeira; mas, para que não se desse um detrimento nos direitos dos trabalhadores se abriu o caminho para que quem respondesse pelos créditos laborais fosse o Estado colombiano e não o Estado acreditador.En el aspecto laboral, un trabajador colombiano que haya prestado sus servicios a una misión diplomática no puede acudir a la jurisdicción para pedir el pago de sus créditos laborales, debido a la inmunidad de jurisdicción contemplada desde 1961 en la Convención de Viena sobre Relaciones Diplomáticas. Esta teoría hoy es rebatida, y fiel reflejo de eso es la jurisprudencia de las altas corporaciones colombianas como la Corte Suprema de Justicia y la Corte Constitucional. La última teoría que se maneja por el derecho internacional es la de la inmunidad jurisdiccional relativa, la cual tendría sustento en la Convención sobre las Inmunidades Jurisdiccionales de los Estados y de sus Bienes, adoptada el 2 de diciembre de 2004 en Nueva York, que recoge la costumbre internacional sobre el tema.
