This paper aims to redefine the theoretical framework regarding the determination of
the scope of the right to privacy in order to ensure human dignity in the modern context. The
traditional mechanisms for determining the scope of ‘privacy’ are usually based on spatial
metaphors, time segmentation or physical barriers. However, nowadays, great part of social
interaction take place in ‘digital places’, where these mechanisms lose their effectiveness.
To face this complexity, it is necessary to recompose the notion of ‘reasonable expectative
of privacy’, which is usually distorted by a restrictive approach when applied to ‘digital
workplaces’. |
