Sumario: ABSTRACT: The main objective of this work is to question the traditional view regarding proof by testimony, raising the necessity of generating a wide concept of testimony that allows the inclusion of other testimonies in trials in its regulation and analysis. The analysis, from a widespread perspective of testimony, shall distinguish, in the stages of conformation and value of the evidentiary material, between the party making the declaration -the agent- and the product of such declaration -testimony as such-, since otherwise, according to the civil law in force, the agent ends contaminating the product.
