Laburpena: Some questions to answer: Can an arbitrator declare a law unconstitutional? Can this declaration of unconstitutionality be applied in other arbitration cases? Can constitutionality control be carried out by arbitrators or only by constitutional judges? It was necessary to study how procedural figure has been developed in Colombia and other countries. It seems to be a simple answer, but the truth is that it is necessary to clearly explain the arbitrator´s duty that exceptionally and temporarily has jurisdiction and competence. The arbitrator’s function is directly related to jurisprudential development and to what is known as effective judicial protection in Colombian arbitration.
