Sumario: The definition of the latin expression animus or affectio societatis has supposed a challenge for the doctrine and the jurisprudence of Colombia and other countries around the world, since it does not exist consensus about its defining elements and its importance. Thus, is it possible to consider the loss of the animus societatis as a cause of dissolution for the company in Colombia? To answer this question, the methodology followed in this work consists in presenting and analyzing by means of a case law and doctrinal compared study the the various definitions that have been given to the animus societatis. From this, it concludes that it is not possible to accept the disappearance of the animus societatis as an autonomous cause of dissolution, as its constitutive elements tend to merge with other legal institutions present in any contract.
