Both of them should be considered victims of a crime. It should be given support to the protective adult who denounced parental sexual abuse for abetter recovery of the child. In the judicial process when the custody of the child and the communication regime is treated the child and his or her physical, emotional and psychological safety and integrity must be protected in relation to the father denounced. A new-look in order to break the historical impunity and help its victims to recover against a crime that affectsus all as human beings: paternal incest.La palabra de niñas, niños suele ser la única evidencia de los abusos sexuales paternos. No hay más testigo que la propia víctima. Los niños y niñas cuando pueden hablar del abuso recurren en la mayoría de los casos a un adulto protectory relatan los hechos. El adulto protector no abusivo es en la mayoría de los casos la madre. Ambos deben ser considerados víctimas del delito. Debe darse apoyo a la madre protectora que denunció el abuso sexual paterno para lograr la recuperación del niño/a. En el proceso judicial por custodias y regímenes comunicacionales se debe contemplar que el niño/a es víctima de un delito denunciado y se debe resguardar su seguridad e integridad física, emocional y psicológica con relación al padre denunciado. Es hacer efectivo el acceso a la justicia de niñas y niños víctimas de delito y de su madre protectora –víctima también-para fortalecerla en la recuperación y protección de sus hijos.
