The aim of the punishment according to Kant is a recurrent topic in the
Philosophy of Crime and Punishment. There are different interpretations on this
matter. The authors take for their reasoning the passages of “The Metaphysic of
Moral”. We choose, instead, in this research to analyse it from another kind of source, namely “The lectures on ethics”. The lectures help to reveal how Kant generated his
point of view that was embodied in their practical philosophy works; they are also
useful to clarify their contradictions. With this aim in mind, we select the nonduplicate group of notes as the sources of information; these notes cover the period
(approximately) between the years 1766-1794. During that period, we visualize, in
the first instance, Kant as a defender of the deterrence and, in a second instance, Kant
accentuates the absolute criteria. The conclusions we arrive are, however, partial, due
to the nature of the selected sources. |
