The practice and the international case law -within the United Nations and the Council of Europe- have recognized the extraterritorial applicability of international texts on protection of human rights but with subtle differences. This article pays particular attention to the development of the case law of the European Court of Human Right (ECHR). As for the latter, when a State is exercising effective control over a foreign territory, its responsibility is compromised by the acts committed by its armed forces, as well as by the local authorities supported thereby.Una de las cuestiones más controvertidas en la última década en materia de protección internacional de derechos humanos es su aplicación extraterritorial en situaciones en las que un Estado ocupa el territorio de otro Estado por razones beligerantes. La práctica y jurisprudencia internacional -en ámbito de la Organización de las Naciones Unidas y del Consejo de Europa- han reconocido la aplicabilidad extraterritorial de los instrumentos internacionales de protección de derechos humanos en estos casos, aunque con matices. Especial atención se presta en este artículo a la evolución de la jurisprudencia del Tribunal Europeo de Derechos Humanos (TEDH).
