Additionally, the assertion of the indigenous movement that encompass from respect for the preservation of their culture to an active participation in every level of government, their demand for recognition of the different indigenous languages, as well as their costumes, cultures and access to justice, and their struggle to eliminate government discriminatory policies. It states the importance of the Agreement Regarding Identity and Rights of the Indigenous People that was consolidated with the issuance of the Framework Law of the Peace Agreements and the approval of Convention 169 of the International Labor Organization regarding Indigenous People and Courts in Independent Countries. These legal instruments warranty to date, the protection and subsistence of the indigenous people and somehow legitimize its movement in the struggle for their demands.Este trabajo aborda el reconocimiento de los pueblos indígenas en las Constituciones de Guatemala (1945,1956, 1965 y la actual 1985) para reconocer sus derechos y crear políticas que les permitieran desarrollarse. Además, las reivindicaciones del movimiento indígena que abarcan desde el respeto por la preservación de su cultura hasta una participación activa en todos los niveles del Estado, su exigencia el reconocimiento de los diversos idiomas indígenas, así como de sus costumbres, cultura y en el acceso a la justicia y su lucha por eliminar las políticas discriminatorias del Estado. Señala la importancia del Acuerdo sobre la Identidad y Derechos de los Pueblos Indígenas que a su vez se consolidó con la promulgación de la Ley Marco de los Acuerdos de Paz y la aprobación del Convenio 169 de la Organización Internacional de Trabajo sobre Pueblos Indígenas y Tribunales en Países Independientes.
