Laburpena: The European public procurement law has overtaken the classic paradigm of public procurement of innovation, which is reflected in the national legal systems /domestic law) of the Member States. Within this community framework, the procedure known as “Innovation partnership” is created, for the development and subsequent procurement of the products that the public Administration needs, but which are not available on the market. Its new nature, the discretionary powers that are found within it and, above all, the uncertainty attached to any innovation process, require the study and implementation of this process from the perspective of the good administration in a broad sense
