Within the framework of hegemonic neoliberal globalization in Colombia, the State has mobilized the law in general and the penal classification in particular trying to guarantee the conditions of its implementation. This process has been characterized by deepening the conditions of inequity both in the country and to the whole world; this has given rise to diverse expressions of social mobilization, many of which are carried out through protests and blocking of public roads. In this context, expressions of discontent have been criminalized so that the normal development of the market is guaranteed. This article seeks, through a qualitative and documentary methodology, to investigate the budgets and legal-political conditions exalted by criminalizing the crime of obstruction of public roads that affect public order in the context of the new global order.

Este processo caracterizase por aprofundar as condições de desigualdade no mundo inteiro e no país; isto suscitou diferentes expressões de protesto social, muitos dos quais são realizados por meio de passeatas e bloqueios das vias públicas. Neste contexto foram criminalizadas as expressões de insatisfação de modo a garantir o normal desenvolvimento do mercado. Este artigo visa, por meio de uma metodologia qualitativa e documental, investigar os pressupostos e condições jurídico-políticas da criminalização enaltecida pelo tipo penal de obstrução das vias públicas, afetando a ordem pública, no contexto da nova ordem globalizada.En el marco de la globalización neoliberal hegemónica en Colombia el Estado ha movilizado el derecho en general y el ordenamiento penal en particular procurando garantizar las condiciones de su implementación. Este proceso se ha caracterizado por profundizar las condiciones de inequidad en el mundo entero y en el país; esto ha suscitado diversas expresiones de protesta social, muchas de las cuales se llevan a cabo a través de marchas y bloqueos a vías públicas. En este contexto se han criminalizado las expresiones de descontento de modo que esté garantizado el normal desenvolvimiento del mercado.
