Sumario: The paper analyzes some of the main judgments of the ECHR on gender equality and human rights with a gender perspective. Since 2000, the Court has issued several judgments recognizing the existence of direct discrimination based on gender. In these judgments, it was echoing the new trend of european society to the equitable distribution of work and family responsibilities between women and men. However, the Court has not argued to the same extent in terms of indirect discrimination or positive action measures. Likewise, in some rulings on women’s rights (especially in matters of gender-based violence and sexual and reproductive rights), the ECHR has applied the gender perspective, but has done so in a still insufficient way.
