Sumario: This paper focuses on the inclusion inside the civil and State responsibility of a new typology of extrapatrimonial damage resulting from the violation of constitutional and conventionally protected goods and rights, which has been assumed by the Council of State and the Supreme Court based on constitutional criteria that are those pretended to be exposed, initially proposing the process of constitutionalisation of responsibility that has given way to the emergence of the new categories of damage, then studying the protection of property and rights recognized conventionally and ending with the approach of comments that have been generated in front of the topic.
