Análisis social y jurídico de los daños ocasionados por minas antipersonal

The purpose of this review article is to analyze the different reparations existing in the Colombian legal system in relation to the victims of anti-personnel mines (MAP) and the harm they have caused over the years worldwide. For this purpose, it starts from a documentary and hermeneutic study, examining the history of explosive devices, and bringing together experiences of social reconstruction such as El Salvador, Ecuador and Peru among others. It starts from the human being as the author of peaceful and violent stories, where dignity is used as a dissipator of transgressions through human rights, coined to provide protection to the victims of atrocities of existing armed actors, where not only the Cessation of hostilities, but also the reparation of the damages caused and the truth of the events occurred. Therefore, the numbers of victims are studied at national level, confronting the victims of the Department of Norte de Santander, where it can be concluded according to the documents analyzed, that this region is a constant scenario of violence, where different armed groups Exert control of the territory and spread distress in communities distant from the urban case.

Pour ce faire, on part d'une étude documentaire et herméneutique, en examinant l'histoire des engins explosifs et en évoquant des expériences de reconstruction du tissu social comme le Salvador, l'Équateur et le Pérou entre autres. Il commence par l'homme en tant qu'auteur d'histoires pacifiques et violentes, où la dignité est utilisée comme un dissipateur des transgressions à travers les droits de l'homme, inventé pour fournir une protection aux victimes des atrocités des acteurs armés existants, où non seulement le cessation des hostilités, mais aussi la réparation des dommages causés et la vérité des événements. Par conséquent, les chiffres des victimes au niveau national sont étudiés, en faisant une comparaison avec les victimes du Département du Norte de Santander, où il peut être conclu selon les documents analysés, que cette région est un scénario constant de la violence, où différents groupes armés y exercent un contrôle sur le territoire et propagent l'anxiété dans les communautés éloignées de la zone urbaine.O objetivo deste artigo de reflexão é analisar as diferentes reparações existentes no sistema jurídico colombiano em relação às vítimas das minas antipessoal (MAP) e os danos que causaram ao longo dos anos em todo o mundo. Para tanto, parte de um estudo documental e hermenêutico, examinando a história dos engenhos explosivos e trazendo à tona experiências de reconstrução do tecido social, como El Salvador, Equador e Peru, entre outros. Ela parte do ser humano como autor de histórias pacíficas e violentas, onde a dignidade é usada como um dissipador de transgressões através dos direitos humanos, cunhada para fornecer proteção às vítimas de atrocidades de atores armados já existentes, onde não só é cessação das hostilidades, mas também a reparação dos danos causados ea verdade dos acontecimentos. Assim, estudam-se os números das vítimas em nível nacional, comparando-se com as vítimas do Departamento de Norte de Santander, onde se pode concluir, segundo os documentos analisados, que esta região é um cenário constante de violência, onde diferentes grupos armados eles exercem o controle do território e espalham a ansiedade em comunidades distantes da área urbana.El presente artículo de reflexión tiene por objeto analizar las diferentes reparaciones existentes en el ordenamiento jurídico colombiano en relación con las víctimas de minas antipersonal (MAP) y el perjuicio que han causado éstas a lo largo de los años a nivel mundial. Para tal propósito se inicia desde un estudio documental y hermenéutico, haciendo examen de la historia en materia de artefactos explosivos, y trayendo a colación experiencias de reconstrucción de tejido social como lo son El salvador, Ecuador y Perú entre otros. Se parte desde el ser humano como autor de historias pacíficas y violentas, donde se emplea la dignidad como disipador de trasgresiones a través de los derechos humanos, acuñados para brindar protección a las víctimas de atrocidades de actores armados existentes, donde no solo se exige el cese de hostilidades, sino además la reparación de los daños causados y la verdad de los hechos ocurridos.
