Sumario: This article argues that the Supreme Court of Justice entered the political field and at the same time it increased autonomy and gain symbolic power through a judicial implementation by the institutionalized political class linked to (mercenaries) armed forces and by using the presidential power and having majority in Congress. To illustrate this hypothesis the research is divided into three parts. The first is details the talks between Pierre Bourdieu and Duncan Kennedy as a perspective of analysis of judicial decisions. The second is to describe the capacity and complexity phenomenon called “parapolitica”. The third is devoted to examining judicial decisions in which the Court defines the monopolization of the investigation and adjudication of constitutional measures, the rules of such procedures and jurisdiction.
