This paper addresses, from a theoretical-practical perspective, the heterogeneous legal problems of
prenatal damage in the context of medical responsibility (private or public). In addition to the cause of injuries by medical
malpractice at the time of childbirth or in the course of pregnancy, and without obviating the actions “wrongful death”
(by prenatal death) and “wrongful conception” (by unwanted birth of a healthy son), a particular attention deserves the
two main categories of claims by erroneous or non-existent prenatal diagnoses: the “wrongful birth” actions, where the
compensation of the moral damage of the parents for the loss of opportunity to opt for the voluntary interruption of
pregnancy has a notable support of the doctrine and the jurisprudence; and the “wrongful life” actions that, formulated
in the name of the son born with the serious anomalies not detected, are generally rejected from the dogmatic level
and usually dismissed by the judges. |
