The article is structured in two parts, the first one is addressed to explain the functions of the criminal legal asset and the main contradictions that exist in relation to its legal nature; While the second examines the main challenges and contradictions that, in relation to intellectual property, and specifically, copyright aspects are manifested in its conception as a criminal law. In the development of the article we use research methods that are applied in both the social sciences and in the legal sciences, including: analysis, synthesis, induction and deduction, theoretical-legal, analytical exegetical and comparative law. The article draws attention to the theoretical foundations that allow the configuration of copyright as a criminal law in modern criminal legal systems, especially in countries belonging to the Central American Integration System.El presente artículo tiene como objetivo analizar desde la concepción teórica del bien jurídico penal, los fundamentos para considerar a la propiedad intelectual y, específicamente al derecho de autor como bien jurídico penal. El artículo se estructura en dos partes, la primera está dirigida a explicar las funciones del bien jurídico penal y las principales contradicciones que existen en relación a su naturaleza jurídica; mientras que, la segunda analiza los principales retos y contradicciones que, en relación a la propiedad intelectual, y específicamente, al derecho de autor se manifiestan en su concepción como bien jurídico penal. En el desarrollo del artículo se utilizan métodos de investigación que se aplican tanto en los estudios de las ciencias sociales como en las ciencias jurídicas, entre ellos: el análisis, síntesis, inducción y deducción, teórico-jurídico, exegético analítico y el de Derecho Comparado.
