Summary: The phenomenon of collaborative consumption in the tourist accommodation sector has experienced an unstoppable boom in recent years, offering an alternative to the usual lodging systems. However, the emergence of this new business model -or rather, its incredible expansion- has unleashed the misgivings of traditional operators and has led to an initial takeover of a restrictive position, mainly by the municipal authorities and the CC. AA. , which have responded with a new, strict and heterogeneous regulatory framework. The objective of this paper is the analysis of some of the most controversial provisions of these regulations, assessing their suitability for the resolution of the identified problems as well as the possibility of their treatment through other more permissive alternative measures.
