Summary: The problem-oriented core of this paper is the responsibility of the State-judge regarding the materialization of in dubio pro reo when the criminal collegiate judge does not take his condemnatory decision unanimously. This approach is supported by the hypothesis that considers the realization of a special mode of in dubio pro reo when the collegiate judge does not adopt the sentence without dissent, generating uncertainty in the criminal responsibility of the accused, and therefore liability State. For this analysis, we study the different positions taken by the Colombian State Council to resolve cases about unjust deprivation of liberty, together with the different voting systems of the collegiate judge.
