Summary: The present essay aims to be a thought about the important role played by the Constitutional Court in the build-up of the Autonomy State. Its origins could be found, as far as it is known, in the not plenty definition of the territorial model in the Spanish Constitution, pushing the Court to play a role maybe a little bit to excessive. In the text we show some examples of that building, with the remarkable point of a coherent reasoning. At the end we set a bunch of proposals of constitutional reforms, trying to set some tools to prevent and solve the inevitable conflicts that take place.
