Summary: In the process of society’s adherence to the Law, we can identify public opinion as one of the components of the expression of society’s demands, naturally only in those societies that correspond to the liberal or democratic model, as one might call them. This goes so far as to make it possible to refer to a relationship of homogenization between public opinion and Law. Here we analyze the preconditions for the existence of public opinion within society: freedom of expression in the public as well as private arena of subjects who are on equal footing, so that their opinions all are equally valid. For public opinion to be well formed, an education in values is required; it is here that the intellectuals have an important moral function to fulfill, so that public opinion is not manipulated and is built based on access to true information.
