Through the historical and bibliographical method, this article aims to present a critical appraisal of the logic and rhetoric evolution, specifically how the enthymemes are currently used to support judicial decisions. The paper intends to prove that the decision-making precedes the writing process and it is not necessarily guided by a formal logic reasoning but, especially, through an ideological motivation, and also that the wording can be done based on enthymemes. |
