Sumario: This academic article tries to analyze the form how the Law 790 of 2002 by which the program of renovation of the public administration with the restriction of the "social detent" settled down, in his article 12 it generated a discrimination for the parents head of household, to those who it was not sheltered to them with the propose exceptions, leaving without sustenance to the children of these families and the arguments that the Constitutional Court used to declare conditionally exequible east article and to preserve the rights of these children through the labor stability of its parents.
