Summary: The closest possibility to the domain and subsequent control of a phenomenon is to know it. Administrative discretion is one of the unfinished items of Administrative Law; when discussions seem to cease, the topic re-emerges with new lights. For the dynamics of administrative activity it is a source of constant re-evaluation so as to achieve an efficient acting Administration. This paper briefly discusses major issues surrounding the discretion of Public Administration, in our view, essential to understanding the answer to the existence of such a contentious and controversial institution.
