Objective: To identify the current responsibility of the states of the former Yugoslavia with regard to respect for the rules defined by international humanitarian law. Methodology: Historical analysis based on documents and studies related to the subject. Results: the violation of Human Rights and International Humanitarian Law entails individual sanction by the International Criminal Court, a body that has had significant background as the International Criminal Tribunal for the Former Yugoslavia, through which one of the crudest barbarities is judged in the history of mankind. Conclusions: in the former Yugoslavia is a clear violation of the principles of international humanitarian law, and the intervention of the International Criminal Court consolidates has been a key to resolve the problem and create deterrents background factor.

Metodologia: Histórica análise com base em documentos e estudos relacionados com o assunto. Resultado: a violação dos Direitos Humanos e Direito Internacional Humanitário implica sanção indivíduo pelo Tribunal Penal Internacional, um órgão que tem tido fundo significativo como o Tribunal Penal Internacional para a ex-Jugoslávia, através do qual uma das barbaridades mais cruéis é julgado na história da humanidade. Conclusões: na ex-Jugoslávia é uma clara violação dos princípios do direito internacional humanitário, bem como a intervenção do Tribunal Penal Internacional consolida tem sido a chave para resolver o problema e criar impedimentos fator de fundo.Objetivo: Identificar la responsabilidad actual de los estados de la antigua Yugoslavia en relación con el respeto a las reglas definidas por el Derecho Internacional Humanitario. Metodología: Análisis histórico basado en documentos y estudios relacionados con el tema. Resultados: la violación de los Derechos Humanos y del Derecho Internacional Humanitario acarrea la sanción individual por la Corte Penal Internacional, órgano que ha tenido antecedentes importantes como el Tribunal Penal para la Ex Yugoslavia, a través del cual se juzga una de las más crudas barbaries en la historia de la humanidad.
