Summary: The university autonomy confirmed to constitutional level, jurisprudentially formed and legally developed, constitutes the cornerstone on which rests the functioning of the Public Universities. In the juridical literature we can find voices of great prestige that, fundamentally from the academic world, have defended to tooth and nail this right invoking the multiple benefits that derive from its exercise. In this article, making good the saying of which all that glitters is not gold, and departing fundamentally from the reports of the Spanish Court of Auditors and the OCEX, there are approached some of the problems that are a direct consequence, to greater or lesser degrees, of the university autonomy and of the distribution of powers designed by the state legislator for its safeguard. Problems, regardless of the constitutional protection given to its content, should make think over to the state legislator, whether we are faced with occasional excesses and tolls that must be supported by society or whether, instead, they should serve as a basis to assess the extent and scope of university autonomy.
