From that perspective and framework it is examined thejurisprudence of the Court concerning procedurals matters on itscompetence, in particular, whether in the circumstances of the case,an objection lacks an exclusively preliminary character or the Courtmust reserve its decision on this issue for further proceedings, consideringthe difficulties relating to the application of article VI of thePact of Bogotá and the determination of the subject-matter of thedispute by the Court in order to decide about its jurisdiction and itseffects on the final judgment. |
