This essay discusses the historical transition that occurred from the mid 90s in Brazil from the Alternative Law movement to legal and criminal Guaranteeism,the landmark of the critical criminology. The hypothesis is that the acceptance to Guaranteeism represented a response to criticisms against the stream. Historical experiences of Magnaud, Kantorowicz and Neumann are used as interpretative resources to understand the critical foundation and the transition: negative criticism of the foundations and assumptions of dogmatic positivism; positive review of building an emancipatory legal praxis. |
