The purpose of this article is to discuss the relationship between State and globalization, by introducing concepts related to the Cooperative Constitutional State as idealized by Peter Häberle, establishing a connection to the value of solidarity and the idea of human development, to, later, deal with current proposals of global governance characterized by Objectives of Millennium Development and Objectives of Sustainable Development. Thus, the first part of the article presents the general characteristics of the globalization process and its impact on the historical basis of the State-nation formation, specially in the concept of sovereignty. The second part is dedicated to categorization of the cooperative constitutional State and its elements, to then deal with the rope played by the value of solidarity in orienting the power relationships in pro of performance of human development. Finally, the third and last part presents the Objectives of Development of the Millennium and those of Sustainable Development Objectives, in order to discuss the difference in their respective formation processes, and characterization of a possible human evolution in terms of global governance, to provide hope of a future institutionalization of the Cooperative Constitutional State. |
