Sumario: This article aims to propose a systematic interpretation of the National Political Constitution that allows the reaffi rmation of the solidarity principle as the guiding rule with regards to social rights, overcoming the actual application of the subsidiarity on this matter as the hegemonic doctrine and political actors have suggested, whose main effect has been to preserve the material value of a minimum Subsidiary State which actions have been characterized for being exceptional and temporary, thereby preventing the establishment of universal social rights in Chile.
